German court rules Motorola Xoom is not iPad clone

A German court has ruled that the Motorola Xoom tablet does not copy Apple's iPad.

While the original Xoom may not be the newest tablet on the block, last August, the Cupertino-based company filed a complaint with the European Union, citing similarities in design over three patents. Motorola attempted a counter-claim, alleging that the iPad's design patent was invalid, but the court rejected this claim, according to the Dow Jones Newswires.

Before the ruling was finalised, the judge remarked that the shaped edges and "the evenly bent back" were differentiating features enough to separate the design from that of the iPad. Apple was ordered to pay two-thirds of court costs, while Motorola picked up the remaining third.

The rumour now is that Apple will make an iPhone with a bigger screen and a "Mini" iPad! Sounds like copying to me!! Go Samsung and Motorola - sue them!!

The problem is judges have no idea how to program how much is beneath the surface. They see the outside of some device. It has a screen. You can poke it with your finger therefore they are the same. This time the German judges seemed to be a bit smarter.

The lawsuit was just about the looks, not the software.

Though granted, a judge doesn't have to be that smart to tell the difference

Correct Apple has patented certain 'looks'

Where Apple needs to be careful is that Motorola has many, many patents in regards to mobile phones and wireless communications.

Hear about the ruling in the UK. For the next 6 months, Apple have to have "Samsung did not copy the Ipad" on their website.

i agree with trebor83, these sort of cases need to almost immediately be dismissed. they are the biggest wast of time, and money for any country dealing with such stupidity

I'll smile when these cases (from all sides I might add) start getting thrown out of court for being the frivelous lawsuits they are.

I expect to be grumpy for sometime.
